1. Who we are

The website peacefulconsultingusa.com and the online learning platform Peaceful Consulting Academy are operated by Peaceful Consulting USA LLC, 1511 Regency Ct, Arlington, Texas, USA ("Peaceful Consulting", "we", "us").

2. Purpose and scope

These terms govern the use of:

• the website peacefulconsultingusa.com and its pages;
• the Peaceful Consulting Academy platform (accounts, courses, exercises, assessments).

Purchases are also governed by the Terms of Sale. The processing of personal data is described in the Privacy Policy. If there is a conflict regarding a purchase, the Terms of Sale prevail.

3. Access to the website and the platform

3.1. The website is freely accessible. Access to courses requires an account on Peaceful Consulting Academy, created or reused following a purchase (see Terms of Sale).

3.2. We strive to provide continuous access but cannot guarantee it. Maintenance, updates, technical incidents or external causes may interrupt it temporarily.

3.3. Reasonable technical requirements: an internet connection, an up-to-date browser and a valid email address that you can access.

4. Your account

4.1. Your account is personal and individual. You are responsible for keeping your credentials confidential and for activity carried out through your account.

4.2. Account sharing is prohibited. You may not share your credentials, let another person take a course through your account, or use one account for several people.

4.3. You agree to provide accurate information (first name, last name, email, country) and to keep it up to date.

4.4. Report any unauthorised use promptly to support@peacefulconsultingusa.com.

5. Acceptable use

You agree not to:

• circumvent technical access measures (access period, progressive release of content, exams);
• scrape or automate the copying of content;
• harm the operation, security or integrity of the website or the platform;
• post or transmit unlawful or defamatory content, or content that infringes the rights of others;
• impersonate another person.

In the event of a serious or repeated breach, we may suspend or close the access concerned, after informing you where possible.

6. Intellectual property and content licence

6.1. Ownership. The content of the website and the platform is protected by copyright and other applicable intellectual property rights: in particular courses, texts, videos, exercises, assessments, tools, materials, methods presented, visuals, trademarks and names.

• Operator and seller: Peaceful Consulting USA LLC operates the website and the platform and sells the programmes.
• Rights holders: depending on the content, rights belong to Peaceful Consulting USA LLC, to the author of the work (for example Bertin Tchinda for his books and the works he authored), to co-authors, or to third parties. Peaceful Consulting USA LLC exploits some content as rights holder and other content under a licence or exploitation right.
• Attribution: author and co-author credits shown on works, books and programmes are kept. The fact that Peaceful Consulting USA LLC sells a piece of content does not mean that it holds all copyright in it.
• Third-party content: it remains the property of its rights holders.

6.2. Licence granted. Subject to payment and compliance with these terms, you receive a personal, non-exclusive, non-transferable and non-sublicensable right to access and use:

• the content of the product purchased;
• for the access period set for that product;
• for your own personal learning.

6.3. Prohibited uses. Unless we give prior written permission, the following are prohibited:

• redistribution;
• resale;
• substantial reproduction;
• making content publicly available (websites, social networks, groups, file-sharing platforms);
• translation or adaptation intended for third parties;
• any commercial exploitation of the content, including to train, coach or certify third parties.

PULSE titles are addressed in the Terms of Sale and the Disclaimers.

6.4. Your contributions. The answers you enter in exercises belong to you. You authorise us to store and process them solely to operate your programme (see Privacy Policy).

6.5. Trademarks and names. "Peaceful Consulting", "Peaceful Consulting Academy" and "PULSE" are used by Peaceful Consulting. Any unauthorised use is prohibited.

7. Third-party content and external links

The website may contain links to or integrations with third-party services: Stripe and PayPal for payment, Calendly for booking. These services are governed by their own terms and policies. We are not responsible for their content or practices.

8. Disclaimers

The content is provided for information, training and personal or professional development. It is not medical advice, psychological advice, or personalised financial, tax, legal or investment advice. Detailed disclaimers are set out in the Disclaimers document, which forms an integral part of these terms.

9. Liability

9.1. You remain solely responsible for your decisions and actions, including those taken following any content, exercise or exchange.

9.2. To the extent permitted by applicable law, our liability is limited to direct and foreseeable damage. It is capped at the amount paid for the product concerned.

9.3. Nothing in these terms limits any liability that cannot lawfully be limited, or the mandatory rights granted to consumers by the law of their place of residence.

10. Changes

We may update the website, the platform and these terms. The applicable version is the one published on the date of use. For a purchase, the version accepted at the time of the order is kept on record (see Terms of Sale). A change does not retroactively reduce the rights attached to a purchase already made.

11. Governing law and disputes

These terms are governed by:

• the laws of the State of Texas (USA);
• the jurisdiction of the competent courts of Tarrant County, Texas;
• subject to the mandatory consumer protection rules of the consumer's country of residence and to any prior amicable resolution procedure.
